Question 2: The Trump Administration rescinded DACA on September 5, 2017, with the expectation that the Congress would act on the legal status of DACA individuals. That never happened. The Supreme Court heard arguments on the legality of DACA and ruled, 5-4 on June 18, 2020 that the program could remain in place. On July 17, 2020, a federal judge in Maryland ordered the administration to begin accepting new DACA applications in accordance with the Supreme Courtรขยยs ruling. However, on July 28, Acting DHS Secretary Chad Wolf issued a memorandum modifying DACA to only accepting applications from existing DACA recipients to renew their protections for one year, rather than two years. The Wolf memorandum was subsequently challenged and on September 23rd a federal judge said Chad Wolf was not legally serving as the Acting Secretary of Homeland Security when he issued his DACA memorandum in July. Therefore, the U.S. District Court of the Eastern District of New York ruled that Wolfยs memo was invalid and the program could continue as it was in 2016.
